The Following Is A Sample Of The Contract Used When A Rescue Irish Water Spaniel is Adopted:

 

 

CONTRACT FOR TRANSFER OF OWNERSHIP TO A NEW ADOPTIVE HOME

BY THE IRISH WATER SPANIEL CLUB OF AMERICA RESCUE/REHOME

CONTRACT

This contract represents the entire agreement between Rescue/Rehome of the Irish Water Spaniel Club of America and the new Owner(s) of a purebred Irish Water Spaniel.

 

The placement and adoption of ___________, an Irish Water Spaniel, described as follows

,

is made with ___________________________, as the new owner(s) upon the following

 

Terms and Conditions:

 

 

  1. The Owner(s) shall assume all ownership responsibilities including but not limited to the health, welfare and daily upkeep of this animal. The owner will cooperate with the Irish Water Spaniel Club of America in regards to all future genetic and health studies that may be ongoing in the breed.
  2. At the time of placement, this animal has no known or apparent faults or defects, other than those listed under remarks, herein, and is expected to develop and to be maintained as family pet. However, the Irish Water Spaniel Club of America is making no guarantee as to the eventual quality or size of this dog, coat quality, type, color, or density or temperament and future health.
  3. This new adoptive Owner(s) will have this Irish Water Spaniel examined by a veterinarian at their expense within one week of dog’s placement. At this time, if the animal is determined to be defective or in poor health or for any other reason, it may be returned to the Irish Water Spaniel Club of America Rescue and Rehome. If the Owner(s)s choose to have any veterinary treatment performed before the animal is returned, the Irish Water Spaniel Club of America Rescue/Rehome is not responsible for the cost.
  4. Owner(s) agree to have this Irish Water Spaniel vaccinated according to a schedule of usual and customary accepted veterinary practices and to provide all necessary and reasonable heath care for this animal. The Irish Water Spaniel Club of America Rescue/Rehome has had all vaccinations given to this animal due through the date of the placement of the animal. The health history of this Irish Water Spaniel insofar as it is known, is attached to this document and made a part hereof. All health records of the Irish Water Spaniel herein will be made available to the Club for genetic research on its request. The new owner agrees to keep the Rescue/Rehome informed of any unusual problems or health issues that may arise with this animal.
  5. The new owner will keep in contact with the Irish Water Spaniel Club of America and on a periodic basis (to include at least each Christmas) will inform the Rescue/Rehome Committee of the Club of the current condition of the animal. Upon the death of this Irish Water Spaniel, the Owner(s) shall inform the Club Rescue/Rehome of the event, including the cause of death.
  6. Owner(s) agree that, in the event that s/he can no longer keep this animal, s/he agrees to never sell, give away, or otherwise dispose of the dog without the written consent of the Irish Water Spaniel Club of America Rescue/Rehome. If such situation arises, Owner(s) shall return the dog directly to the Irish Water Spaniel Club of America Rescue/Rehome. If shipping is necessary, the Irish Water Spaniel Club of America Rescue/Rehome will be responsible for the expense of returning the dog. The Owner(s) will not receive any monies for the animal from the Irish Water Spaniel Club of America and will sign over the animal’s registration at the time of its return. The Owner(s) acknowledges that the Irish Water Spaniel Club of America Rescue/Rehome requires this agreement because the Irish Water Spaniel Club of America Rescue/Rehome cares about the future of this dog for its entire life and is willing to assume responsibility for finding an appropriate, loving, new home should it ever become necessary.
  7. The Owner(s) understand that the Irish Water Spaniel herein has been implanted with the AVID microchip and agree to register the animal immediately and provide the Irish Water Spaniel Club of America Rescue/Rehome with a copy of the registration. The Owner(s) further agrees to leave the name of the Irish Water Spaniel Club of America Rescue/Rehome as the second contact for the life of the dog.
  8. The Owner(s) understand that Irish Water Spaniels are powerful, active, intelligent dogs that require extensive socializing, exercise and training to realize their potential as loving companions. To that end, the Owner(s) agrees to attend dog obedience classes, including but not limited to (a) Puppy Kindergarten/Socialization class between 12 and 20 weeks old; and (b) Basic Dog Obedience Class. All training should be conducted in a Positive Reinforcement method
  9. Owner(s) have affirmed that the animal's new home has a secure environment and any subsequent home that the Owner(s) may move to will also have a secure environment. Owner(s) also agrees that the dog shall be maintained in an adequate enclosed area or on leash, and not be "tied out" or allowed to roam at will.
  10. Owner(s) understand that this dog has been sterilized and that this animal can never be bred. Owner(s) understand that this animal can be entered into any American Kennel Club event other than conformation shows and that such activity is at the option of the owner(s)
  11. As the new owner of a rescue/rehome the Irish Water Spaniel Club of America rescue/rehome agrees to provide mentoring assistance for answering of questions and to provide continuing assistance for the new owner. Your mentors are:

  13. There are situations in which dogs bite. While this dog has shown no tendency toward biting, the IWSCA Rescue and each person involved in Rescue specifically disclaim responsibility if this dog injurres a person. The adopter will hold the rescuers harmless.

 

 

 

In addition to your assigned mentors, at any time you may contact any of the Geographical Chairs of the Rescue/Rehome committee or the National Chair/Coordinator for information and assistance. We want to hear from you. In addition it is strongly recommended that all new Irish Water Spaniel owners join the Irish Water Spaniel Club of America at least for the first year. By joining the Club you will receive a newsletter with information about the IWS. Also, you will receive a list of other members in the Club that you can contact for advise and training hints. Cost: $15.00 each year.

 

The Owner(s) agrees that if there is a violation by the Owner(s) of the terms and conditions of this contract, the Irish Water Spaniel Club of America Rescue/Rehome has the right to reacquire the dog at no cost to the Irish Water Spaniel Club of America Rescue/Rehome. The owner(s) further agree that if this animal is ever found by the Irish Water Spaniel Club of America Rescue/Rehome in a shelter or if an abuse or neglect prosecution is commenced against this owner(s), the Irish Water Spaniel Club of America rescue/rehome automatically reaquires full right, interest and title to this animal and the owner(s) herein agrees under such circumstances that the Owners(s) rights to this animal under those circumstances are absolutely and completely extinguished.

It is strongly recommended that all new puppy buyers join the IWSCA for at least the first year. By joining the club you will receive a newsletter with information about the IWS. Also you will receive a list of other members in the club that you can contact for advice and training hints. Estimated cost: $15.00 per year.
